Aioly is committed to respecting intellectual property rights and ensuring that our community does the same. We do not permit any content that infringes on the copyrights, trademarks, or other intellectual property rights of others. By using Aioly, you agree to comply with our Community Guidelines and Terms of Service, which prohibit uploading, sharing, or distributing content that violates someone else's rights.


Copyright Protection
Copyright protects original works of authorship such as music, videos, and other creative content. It ensures creators can control how their works are used. However, copyright does not extend to ideas or facts, but rather to the specific way a work is expressed.


Copyright Infringement and Reporting
Aioly does not permit content that infringes on the copyrights of others. If you come across any content that you believe infringes your copyright or the copyright of others, we encourage you to report it. We will investigate and, if necessary, remove infringing content promptly. In some cases, we may temporarily suspend or permanently terminate accounts that repeatedly infringe on copyrights.

When submitting a report, please ensure that you include all necessary details as specified in our online Copyright Infringement Report form. Missing information may limit our ability to process your complaint effectively, potentially resulting in the rejection of your report.Aioly may provide the user who uploaded the allegedly infringing content with some of your contact details, such as your name and email address, as well as a summary of the complaint you have filed. This is to facilitate direct communication between you and the content creator, should they wish to discuss the issue further.

We encourage users to resolve any disputes directly with the content creator. If reporting content, please provide sufficient information so we can process your request effectively.Aioly respects the principle of "fair use" in applicable jurisdictions. If content is used under circumstances that may qualify as fair use or another exception under local laws, it may not constitute infringement.


Removal of Content and Account Actions
We will remove content that violates copyright laws when notified. Additionally, users who repeatedly post infringing content may face suspension or termination of their accounts. Please note that we reserve the right to refuse services to users whose accounts have been used for improper activities.

Important Legal Considerations
Please be aware that submitting a false or misleading copyright complaint may lead to legal action under applicable laws, such as the Digital Millennium Copyright Act (DMCA) in the United States or similar regulations in other countries. This could result in you being held liable for damages.

If your report requires further clarification or additional information, we may reach out to you directly. Keep in mind that Aioly is not responsible for resolving disputes between content creators and rights holders. We do not act as a mediator but are committed to taking appropriate action to address valid infringement claims.

EU Copyright Laws
In accordance with the European Union Copyright Directive (EU 2019/790), if you wish to authorize Aioly to distribute your copyrighted works on the platform, please submit your request through the designated form. We will review your submission and follow up with you as needed.

Additionally, if you would like your work to be restricted from being available in the EU, you can submit a request by contacting our support team. We will review and process this information promptly. Upon verification, we will do our best to ensure that your copyrighted work is not made available within the EU region.

Please note that while Aioly offers a process for resolving copyright infringement issues, you retain the right to pursue legal action in court if you wish to enforce your rights further.


Information for Users: Copyright Infringement Counter-Notification

If You Are a User Outside the European Union
IIf you have received a notification of copyright infringement and believe that it is incorrect or that you have permission to use the content in question, we recommend first reaching out directly to the copyright holder to discuss and resolve the matter.

If contacting the copyright holder does not resolve the issue, you may submit a
Counter-Notification through our Counter-Notification Form. Please ensure that your counter-notification includes all required information, as outlined in the form. Incomplete submissions may delay the process or result in the denial of your counter-notification.

The counter-notification process may take time, so we ask for your patience. During this time, the original copyright holder has the option to seek a court order to prevent the content from being reinstated, in accordance with applicable copyright laws (such as the
Digital Millennium Copyright Act (DMCA) in the U.S. or similar laws in other jurisdictions). If this happens, we may forward your counter-notification to the original copyright holder, including any contact details you provide. The copyright claimant may choose to use this information to initiate legal proceedings.

If we do not receive confirmation that the copyright holder is seeking a court order, we may reinstate the content if we determine that it does not infringe any third-party copyrights. Please note that the decision to restore content will be at Aioly’s discretion.

If You Are a User in the European Union
If you receive a copyright infringement notification and believe that you are within your rights to post the content, you can submit a
Counter-Notification via our form. You must provide all relevant information as requested to proceed with the review.

Under EU law, there are certain exceptions that allow users to use copyrighted works without prior authorization. These exceptions include:

Quotation, Criticism, and Review: The use of excerpts from a copyrighted work for purposes such as commenting, defending a viewpoint, or engaging in discussion. It can also be used for reviewing or critiquing works.

Caricature, Parody, and Pastiche: These uses involve modifying or exaggerating a work, often for humorous or satirical purposes. A parody will reference an existing work but must be noticeably different, while a pastiche borrows recognizable elements from other works to create a new piece.
For any use of copyrighted content to qualify under these exceptions, it must meet the conditions of fair use or fair dealing, which include:

1. The use should be no more extensive than necessary.
2. The original source should be properly acknowledged.
3. The use should not unfairly impact the rights or interests of the copyright holder.

Please be aware that all videos, even those that may fall under these exceptions, are still subject to our
Community Guidelines. This means that such videos should not involve harmful content like hate speech, intimidation, or abusive behavior.


Trademark Policy

What is a Trademark?
A trademark is a distinctive word, logo, slogan, design, or a combination of these elements that helps identify the source of a product or service, distinguishing it from other offerings in the market. Trademarks are essential for protecting the brand identity of businesses and ensuring consumers can confidently recognize and engage with trusted products and services.

Trademark Infringement
Trademark infringement refers to the unauthorized use of a trademark or service mark in a way that could confuse or mislead the public about the source, origin, affiliation, or sponsorship of goods and services. The improper use of another entity’s trademark in a way that causes confusion or misrepresentation is a violation of trademark laws.

However,
Aioly recognizes that certain uses of trademarks are permitted, such as when they are used for the purpose of fair commentary, review, or comparison with other products and services. In these cases, the use should not imply an association with the trademark owner or confuse consumers into thinking there is a direct affiliation. For instance, creating fan pages or sharing opinions about a brand without claiming to represent it is typically allowed, as long as it doesn't violate the intellectual property of the brand.

Removal of Content and Account Suspension
Content that infringes on someone else's trademark rights may be removed from the platform. In cases of repeated trademark violations or other breaches of our Community Guidelines and Terms of Service, Aioly reserves the right to suspend or permanently terminate user accounts involved in such actions. Users who engage in repeated violations may also be prohibited from creating new accounts.

Trademark Infringement Complaints and Notifications

We encourage resolving issues directly with the user responsible for the content in question, as it may lead to a quicker and more satisfactory resolution for both parties. However, if this is not effective, you may file a
Trademark Infringement Notification with Aioly.

When submitting a complaint, please ensure that you include all necessary information as requested in our
Trademark Infringement Report Form. If key details are missing, this could impact our ability to address your complaint or even result in the dismissal of your report. Please note that we may disclose your contact information, including your email address and trademark ownership details, to the user whose content is in question, in line with our Privacy Policy and Terms of Service.

Before submitting a report, we advise you to consider that submitting a false or misleading claim could lead to legal repercussions. Fraudulent reports may result in penalties under applicable laws in your jurisdiction.

Trademark Infringement Counter-Notification
If you have received a trademark infringement notification and believe that the claim is incorrect or that you have legitimate rights to use the content, you may challenge the report by submitting a
Counter-Notification.

To do so, please complete our
Counter-Notification Form, providing all requested information. If you fail to include the necessary details, we may not be able to properly investigate your case, and your counter-notification may be dismissed.

Once submitted, the counter-notification will be reviewed, and, if applicable, we may restore the content. Keep in mind that the trademark owner still has the option to seek a legal remedy through the courts, and
Aioly may provide your counter-notification to the original complainant as part of the process.

As a Aioly user, you are solely responsible for the content you upload or share. If you have concerns regarding the legality of your content—such as whether your use of copyrighted material, trademarks, or other protected works may infringe on the rights of others—we encourage you to seek legal guidance.

If you're uncertain about whether your content or your use of someone else’s intellectual property could potentially violate their rights, it’s wise to consult with a legal professional before proceeding with any uploads or reports. This can help ensure that you're complying with applicable laws and protecting both your rights and those of others in the community.

Aioly infringes on someone's rights, we recommend reviewing the situation carefully or seeking legal advice before submitting any complaints. This approach helps us maintain a fair and legally sound platform for all users.
